The Equal Employment Opportunity Commission (EEOC) opened the 2022 EEO-1 Component 1 Report filing system earlier today, October 31, 2023, with a due date of December 5, 2023. The EEO-1 requires covered employers to report by job category the race, ethnicity and gender of its employees. Covered employers include those with 100 or more employees and federal contractors with 50 or more employees and a federal contract of $50,000 or more. The EEOC will require use of the portal it created in 2021 to complete the filing, see link.
Don’t forget that while the report will keep the same format as years past, last year the EEOC discontinued the EEO-1 Component 1 Type 6 Establishment List Report for establishments with fewer than 50 employees. These establishments must use the Type 8 Establishment Report for the 2022 filing cycle (as they did in the 2021 cycle).
As expected, the relevant data should be gathered based on an employer’s workforce from October 1, 2022 to December 31, 2022. Historically, the EEOC has requested data from any single pay period in Q4 of the filing year to be the basis of the report. Therefore, employers will need to create a report that includes all employees who were active during any single pay period (of the employer’s choosing) in either October, November or December of 2022.
